Inclement Weather
In the event of rain, storms, or other unsafe weather conditions, Icarus Illusions Media reserves the sole right to reschedule the session at no additional cost. Weather-related delays or rescheduling shall not constitute grounds for cancellation, refund, or compensation.
Rescheduling Lateness and Cancellation
The Client is permitted one (1) complimentary reschedule with a minimum of forty-eight (48) hours notice. Any additional reschedule requests are subject to availability and may incur additional fees.
A fifteen (15) minute grace period is allowed for late arrivals and is included within the scheduled session time. After the grace period, a $25 late fee will apply. If the Client fails to arrive or communicate within thirty (30) minutes of the scheduled start time, the session shall be considered a cancellation and subject to a $50 rescheduling fee. No-shows are not guaranteed rebooking. If the Photographer/Videographer is delayed, the Client will receive the full contracted session time. Photographer/Videographer delays do not warrant a refund or discount.
Media Delivery
Proofs and First Looks will be delivered within seventy-two (72) hours following the session. Once review has been completed, the full edited gallery will be delivered within ten (10) business days, excluding weekends and holidays. Turnaround times may vary based on gravity of session.
Any request for expedited image delivery must be made in advance. Up to three (3) images may be delivered early for announcements, invitations, etc., and these images will count toward the final total. Expedited delivery is available by request only and is not guaranteed without written approval from Icarus Illusions Media.
Refund Policy
All payments are non-refundable, and all sales are final. If the Client expresses dissatisfaction within twenty-four (24) hours of gallery delivery, Icarus illusions Media may, at their sole discretion, issue a partial refund of up to thirty percent (30%) of the session fee. Artistic style, posing, lighting, composition, and editing choices are subjective and do not constitute grounds for a full refund.
Model/Media Release
The Client hereby grants Icarus Illusions Media the irrevocable, perpetual, and unrestricted right to use, publish, reproduce, display, and distribute images and clips from the session for portfolio use, website display, social media, advertising, marketing, editorial, and promotional purposes, without compensation. The Client waives any right to inspect or approve the final media or their use and releases Icarus Illusions Media from all claims, demands, and liabilities related to image usage.
Copyright & Ownership
All photographs and videography remain the exclusive copyrighted property of Icarus Illusions Media. The Client is granted a personal-use license only, unless otherwise stated in writing. Commercial use, resale, alteration, or redistribution without written consent is prohibited.
Force Majeure
Icarus Illusions Media shall not be held liable for failure or delay in performance due to circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, fire, flood, power outages, equipment failure, government orders, public health emergencies, strikes, civil unrest, transportation issues, illness, or other emergencies. In such events, Icarus Illusions Media reserves the right to reschedule the session at no additional cost. Force majeure events shall not constitute grounds for cancellation, refund, or damages.
Limitations & Liability
To the fullest extent permitted by law, Icarus Illusions Media’s liability for any claim, loss, damage, or injury arising out of or relating to this Agreement or the photography/videography session-whether due to negligence or otherwise-shall be limited to the total amount paid by the Client for the session. In no event shall Icarus Illusions Media be liable for indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, emotional distress, or loss of data or images.
Governing Law & Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to this Agreement shall be brought exclusively in the state or federal courts located within Mecklenburg County, North Carolina, and the parties hereby consent to the personal jurisdiction and venue of such courts.
Agreement & Acceptance Terms
By booking a session, submitting payment, or signing below, the Client acknowledges that they have read, understood, and agreed to all terms of this Agreement. Booking constitutes a legally binding acceptance of this contract.
